Data protection notice pursuant to Art. 13 GDPR and Art. 14 GDPR

1. Data controllers

The data controllers within the meaning of Art. 4 No. 7 GDPR are Piltz Legal and PL Services (hereinafter also: "we", "us"). Further information on the companies can be found in the imprint. This website is operated by both companies, therefore both of them are jointly responsible for data processing on this website. If you address a request exclusively to one of the companies, solely this company is the data controller.

2. Accessing our website

Each time our website is accessed, your browser automatically transmits information to us. This includes:

  • the IP address of your device,
  • date and time of the access,
  • name and address of the requested file,
  • data volume transferred,
  • notification as to whether the request was successfully,
  • information about the browser and operating system used and
  • name of your internet provider.

These data are processed to enable and facilitate the use of our website. In addition, the data are evaluated in anonymised and aggregated form and used to ensure system security as well as the technical management of the network infrastructure. We reserve the right to subsequently review the log data if there is a justified reason to suspect unlawful use based on tangible grounds. The data processings described above are carried out on the basis of our legitimate interests in providing our web offer in a secure manner as well as in evaluating the use of our website and based on Art. 6 Para. 1 lit. f GDPR. Retention period of the data described above is usually 14 days from collection of the data. In exceptional cases, the data are stored to clarify suspected cases of unlawful use until the suspicion is resolved.

On our website, we give you the opportunity to get in touch with us. Moreover, you may contact us or one of our employees by e-mail with an enquiry. If your contact is intended to conclude a contract or is otherwise a pre-contractual measure, data from your contact and about you will be processed to respond to your request on the basis of Art. 6 Para. 1 lit. b GDPR. If you provide us with another type of inquiry in the context of contacting us, we will use the personal data and information about you contained herein on the basis of our legitimate interests in responding to inquiries and using information provided to us pursuant to Art. 6 Para. 1 lit. f GDPR. We store the data related to your enquiry for the duration of our business relationship with you or until you have objected to data processing based on Art. 6 Para. 1 lit. f GDPR and your legitimate interests override ours or the balancing of interests without objection is in your favour.

4. Job application

You have the opportunity to apply for open positions or on your own initiative. Within your application you can provide us with your CV and further information about you, your motivation for applying and your ideas for cooperation. We process the personal data you provide via the application channel you have chosen for the specific purpose of carrying out the application procedure and, if necessary, for contacting you in case of queries. We will also use your contact details to invite you to participate in the next round of the application process, if we are interested in your profile. We will delete data that are obviously irrelevant. In addition, we have a legitimate interest in managing and evaluating your application and information from and about your application procedure. The legal basis for this purpose of data processing is Art. 6 Para. 1 lit. f GDPR.

We process personal data for the exercise and defence of our interests, rights and claims on the basis of our legitimate interests in the exercise and defence of such interests, rights and claims pursuant to Art. 6 Para. 1 lit. f GDPR. Where the processing of special categories of personal data is necessary for the assertion, exercise or defence of legal claims, we additionally carry out such data processing based additionally on Art. 9 Para. 2 lit. f GDPR. In order to clarify inconsistencies, we process personal data on the basis of our interests in clarifying such inconsistencies based on Art. 6 Para. 1 lit. f GDPR. Since you could assert claims against us arising from your application procedure (e. g. under the German General Act on Equal Treatment (Allgemeines Gleichbehandlungsgesetz – AGG)), we store the data necessary to enable the presentation of legally compliant behavior until the respective claims are time-barred based on our legitimate interests in this and based on Art. 6 Para. 1 lit. f GDPR.

Insofar as we are legally obliged to process data that we have received as part of the application process, we undertake this data processing pursuant to Art. 6 Para. 1 lit. c GDPR.

If your job application was successful, we will store your application documents in your personnel file. If the data processing is based on our legitimate interests (Art. 6 Para. 1 lit. f GDPR), the data will be stored for as long as our interests override and the data is necessary to safeguard an overriding legitimate interest. If the data processing is based on a legal obligation to which we are bound (Art. 6 Para. 1 lit. c GDPR), the data will be stored for as long as is necessary to fulfil our legal obligation. For instance, we are bound by the retention periods laid down in German tax law.

If your job application was unsuccessful, we will delete your documents within six months following the decision to decline your application. If we are both interested in working together in the future and if you have given your consent in accordance with Art. 6 Para. 1 lit. a GDPR, we will store your application documents for the future in order to be able to contact you about vacant positions that are potentially suitable for you, as long as you do not withdraw your consent to do so in the future.

5. Newsletter (registration via website)

On our website we offer you the possibility to subscribe to our newsletter. Please note that this section does not apply to the newsletter that existing clients receive, but only to newsletter subscriptions where the registration has taken place via our website.

When you register for the newsletter on our website, it is necessary that you provide us with mandatory information marked as such so that we can enable your registration. You are welcome to provide us with voluntary information, but such information is not mandatory. The legal basis for the processing of your data during the registration process to our newsletter is your consent in accordance with Art. 6 Para. 1 lit. a GDPR.

After completing the process on our website, you will receive an email from us asking you to confirm your email address. Once you have done this, the registration process is completed. To conclude the registration process and in order to be able to send you the newsletter regularly, we use your email address and the information you provided during registration based on your consent pursuant to Art. 6 Para. 1 lit. a GDPR and send you the newsletter with your consent.

You may withdraw your consent at any time with effect for the future. To do so, there is an "unsubscribe" function in the newsletter e-mails and you may also withdraw your consent by sending us an e-mail to datenschutz@piltz.legal.

We measure the opening rate of our newsletter based on our legitimate interests in accordance with Art. 6 Para. 1 lit. f GDPR. Our legitimate interests are to measure the effectiveness of our newsletter and to detect whether emails containing newsletters are opened by our subscribers.

We store the data processed in connection with the newsletter based on your consent until you withdraw your consent with effect for the future or until the data is no longer required for the fulfilment of a legitimate purpose.

In case you subsequently inform us that you no longer want to receive our newsletter, we will store not all your data, however only the necessary ones to ensure that we do not send you any more newsletters, based on Art. 6 Para. 1 lit. c GDPR. This allows us to fulfil our obligation not to send you unsolicited advertising pursuant to Sec. 7 Para. 1 German Act against Unfair Competition (Gesetz gegen den unlauteren Wettbewerb - UWG).

6. Law firm events

You have the possibility to register for events organised by us (online or on site). We will use the data you provide within the scope of such registration to organise the event, prepare lists of participants and carry out the respective events and meetings. These data processings are carried out on the basis of our legitimate interests in the planning of the event, creation of participant lists and performance of the respective events and events and based on Art. 6 Para. 1 lit. f GDPR. The storage period of the data is generally 3 months from the day of participation in the event, unless you have given us your consent to receive information about future events and events. In the latter case, we store the data until you withdraw your consent with effect for the future or until the data is no longer required for the pursuit of a legitimate purpose.

Should you notify us that you no longer want to receive information and invitations subsequently, we will retain not all, but only the very necessary data to ensure that we do not subsequently send you any more information and invitations, based on Art. 6 Para. 1 lit. f and c GDPR. Our legitimate interest is to be able to fulfil your request not to receive any further information.

During the event, photos or film recordings may be made. The shootings will be used both for news reporting and for promotional purposes.

7. Cookies and similar technologies

We use cookies and similar technologies on our website. Some of these are required for the provision of our web offer or a function of the website you have requested or for the fulfilment of our legal obligations. We process the personal data obtained using these types of cookies and similar technologies either on the grounds of our legitimate interests in providing our web offering and functions that you requested pursuant to Art. 6 Para. 1 lit. f GDPR or to fulfil a legal obligation based on Art. 6 Para. 1 lit. c GDPR.

For other types of cookies and similar technologies, we ask for your consent within our cookie banner. We process the personal data collected using such cookies and similar technologies on the grounds of your consent based on Art. 6 Para. 1 lit. a GDPR.

8. Data protection rights

As a data subject, you are granted the following data protection rights, if the respective applicable requirements are fulfilled:
